Plazos para subsanar antes del desalojo, estado por estado
El aviso de subsanar o desalojar le indica al inquilino qué cláusula del contrato incumplió y le concede un plazo legal para corregir («subsanar») el problema antes de que el arrendador pueda avanzar hacia el desalojo. Los plazos legales van de 3 a 30 días según el estado, siendo de 10 a 14 días la franja más común. Ocho estados no fijan ningún plazo para subsanar incumplimientos ajenos a la renta, y dejan los derechos del inquilino al contrato.

Cómo funciona el aviso de subsanar o desalojar
Ante un incumplimiento subsanable —una mascota no autorizada, una falta de mantenimiento, ocupantes no aprobados— la mayoría de los estados exige que el arrendador entregue un aviso escrito que identifique el incumplimiento y advierta que el arrendamiento termina después de un plazo determinado salvo que el inquilino lo corrija. Subsanar dentro de ese plazo normalmente cierra el asunto; si el incumplimiento continúa, el arrendador puede presentar el caso de desalojo una vez vencido el plazo.
Plazo del aviso frente a ventana para subsanar
En algunos estados ambos difieren: el aviso fija una fecha de terminación más larga pero concede al inquilino un plazo más corto para subsanar. Kansas, por ejemplo, usa un aviso de terminación de 30 días con una ventana de 14 días para subsanar. Cuando la tabla muestra una ventana de subsanación aparte, la cifra más corta es su fecha límite para corregir el problema.
La reincidencia suele eliminar el derecho a subsanar
Muchos estados acortan o eliminan el derecho a subsanar cuando se repite sustancialmente el mismo incumplimiento dentro de un plazo determinado: Alabama, por ejemplo, permite una terminación de 14 días sin derecho a subsanar por una reincidencia dentro de 12 meses. ¿Cuánto tiempo tengo para corregir un incumplimiento del contrato antes del desalojo?
Depende del estado: los plazos legales van desde 3 días (Idaho, North Dakota, Texas, Utah, Wyoming —y California, contados en días hábiles—) hasta 30 días (nueve jurisdicciones, incluidas Washington, D.C., Maryland, Ohio, Oregon y Virginia). New Jersey usa un aviso de un mes. La franja más común es de 10 a 14 días.
¿Qué estados no garantizan un plazo para subsanar?
Georgia, Indiana, Massachusetts, Michigan, Minnesota, North Carolina, South Dakota y West Virginia no tienen un estatuto que garantice al inquilino la oportunidad de subsanar un incumplimiento ajeno a la renta; el contrato de arrendamiento sí puede concederla. (En Massachusetts, ch. 186 §§ 11–11A cubren solo la falta de pago, así que los demás incumplimientos se rigen por el contrato.)
¿Qué se considera un incumplimiento subsanable?
Por lo general, los que el inquilino puede corregir de forma realista: retirar una mascota no autorizada, resolver una falta de mantenimiento o terminar un subarriendo no aprobado. La conducta grave —actividad ilegal, daños importantes a la propiedad, amenazas a la salud y la seguridad— suele tratarse como no subsanable y recibe en muchos estados un aviso más corto y sin derecho a subsanar.
¿Qué pasa si repito el mismo incumplimiento?
Muchos estados eliminan o acortan el derecho a subsanar ante la repetición sustancial del mismo incumplimiento dentro de un plazo determinado (con frecuencia 6 o 12 meses); el arrendador puede entonces terminar mediante aviso sin oportunidad de subsanar.
