California Tenant Rights in 2025: Complete Guide

Security Deposit Limits

For deposits collected on or after July 1, 2024 (AB 12), California limits security deposits to one month's rent regardless of whether the unit is furnished or unfurnished. This is a significant change from the previous two-month limit. One exception: a small landlord — an individual, or an LLC owned only by individuals, with no more than 2 rental properties and 4 units in total — may still charge up to two months' rent, unless the tenant is a service member. Rent Control and Just Cause Eviction

The Tenant Protection Act (AB 1482) provides:

• Rent caps: Maximum annual rent increase of 5% + local CPI (up to 10% total)—part of California's rent control framework
• Just cause eviction: Landlords must have a valid reason to evict; see lease compliance and eviction for basics

These protections apply to most rental properties that are at least 15 years old. The 15 years is counted from the certificate of occupancy, so the cutoff moves forward every year. Common exemptions include a house or condo not owned by a corporation or REIT (when the tenant received the written exemption notice) and an owner-occupied duplex. Landlord Entry Rights

California requires reasonable written notice before a landlord can enter your unit, except in emergencies, and presumes 24 hours to be reasonable. Entry must be during normal business hours unless you agree at the time. That's your right to landlord entry notice and quiet enjoyment.

Habitability Standards

Your landlord must provide habitable conditions:

• Working plumbing, heating, and electrical systems
• Adequate weatherproofing
• Clean and sanitary premises
• Working smoke and carbon monoxide detectors
• Freedom from pests

Landlords cannot retaliate against tenants for:

• Complaining about habitability issues
• Organizing with other tenants
