No. An animal trained to do a task related to your disability is a reasonable accommodation, not a pet, and waiving the pet policy for it — including its rent and deposit — is required (42 U.S.C. § 3604(f)(3)(B); 24 CFR § 100.204). HUD confirmed in May 2026 that trained-animal cases are the ones it enforces. For an untrained emotional support animal it is less certain: HUD withdrew its assistance-animal guidance in September 2025 and now pursues only trained-animal complaints, though the statute and your right to sue are unchanged and your state may require more.
