It depends on the lease and state. If it's called a 'deposit,' it's often refundable subject to deductions for pet damage. Non-refundable 'pet fees' are not returned. State law may require refundability or limit amounts.
It is less settled than it used to be. HUD's 2013 and 2020 notices said a pet fee could not be charged for an assistance animal; HUD withdrew both on September 17, 2025 and said on May 22, 2026 that it will pursue a complaint only where the animal is individually trained for a disability-related task. The Fair Housing Act itself is unchanged and you can still sue in court, so the argument that an accommodation should not carry a fee survives — it now leans more on your state's law and local court decisions than on HUD. For a trained service animal, a pet deposit or fee generally still shouldn't apply. Either way you remain responsible for damage the animal causes.
State laws vary. Some states include pet deposits in the total security deposit cap (e.g., 1–2 months' rent). Others allow separate pet deposits or non-refundable fees. Check your state and your lease.
