Eviction Grounds (When Eviction Maintainable)

N.D.C.C. § 47-32-01 lists when an eviction action may be brought in district court, including where a tenant holds over after the lease ends, fails to pay rent within three days after it is due, materially breaches a written lease term, or acts in a manner that unreasonably disturbs other tenants' peaceful enjoyment. It also covers unlawful or forcible entry, forcible holding, and continued possession after a mortgage foreclosure, execution sale, deed delivery, contract cancellation, or partition/court-ordered sale. For nonpayment of rent, the landlord must wait until rent is at least three days overdue before an eviction action is maintainable.
