Lead Paint Disclosure (Pre-1978)

For pre-1978 (target) housing rented to a lessee, before the tenant is obligated under the lease the landlord must (1) provide the EPA pamphlet 'Protect Your Family From Lead in Your Home,' (2) disclose any known lead-based paint and lead-based paint hazards, and (3) provide any available records or reports; the lease must include a Lead Warning Statement and signed acknowledgments (42 U.S.C. 4852d; 40 CFR 745.107 & 745.113). The 10-day opportunity to conduct a lead inspection or risk assessment (40 CFR 745.110) applies only to purchasers in sales transactions — there is NO lease inspection period for renters.
